Terms of Service

These Terms of Service ("Terms") govern your use of the VizTurf mobile application and website operated by VizTurf Inc. ("VizTurf," "we," "us"). By creating an account or using the service, you agree to these Terms.

1. Service Description

VizTurf is a turf management intelligence platform for superintendents, sports turf managers, spray technicians, and related professionals. The service provides weather forecasts, spray window calculations, disease pressure tracking, chemical application logging, daily planning tools, and a professional social network.

2. Account Requirements

• You must be at least 18 years old, or have your employer's authorization, to use VizTurf.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• One account per individual. Shared accounts are not permitted.
• You are responsible for all activity that occurs under your account.

3. Subscription Plans and Billing

VizTurf offers the following tiers:

Billing Terms

• Subscriptions are billed monthly or annually via Stripe.
• Subscriptions auto-renew unless cancelled before the renewal date.
• You may cancel at any time. Access continues through the end of your paid period.
• No refunds for partial billing periods.
• We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree to use VizTurf for legitimate professional turf management purposes. You may not:

• Submit false disease reports or misleading data to the regional network.
• Harass, abuse, or threaten other users.
• Upload content that is illegal, obscene, or violates others' intellectual property.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use automated tools to scrape data or overload the service.
• Resell or redistribute VizTurf data without written permission.

5. Content Ownership

Your data: You own all data you create in VizTurf, including logs, observations, plans, photos, and posts. We do not claim ownership of your content.

License to operate: By using VizTurf, you grant us a limited license to store, process, display, and transmit your content as necessary to provide the service. For public Showcase posts, this includes displaying them to other users.

Anonymized data: We may use anonymized, aggregated data derived from your activity for regional features (disease radar, benchmarking). This data cannot be traced back to you or your course.

6. Weather Data and Spray Windows

Weather forecasts and spray window calculations are provided as decision-support tools, not guarantees. Weather data is sourced from third-party providers and may be inaccurate. You are solely responsible for all application decisions, including timing, product selection, and compliance with label requirements and local regulations.

VizTurf is not a substitute for professional agronomic advice, product labels, or your own judgment and experience.

7. Disease Radar

Disease pressure data is based on a combination of user reports and weather-based risk models. It is intended as an early awareness tool, not a diagnostic. The absence of reported disease in your area does not mean disease is not present.

8. 911 Emergency Feature

The 911 emergency feature connects you with nearby turf professionals for peer assistance. It is not affiliated with government emergency services. VizTurf does not guarantee response times or the quality of advice received. In a true emergency, contact your local emergency services.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. Features dependent on third-party APIs (weather, maps) may be temporarily unavailable if those services experience outages.

10. Disclaimer of Warranties

VizTurf is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, that weather data will be accurate, or that disease radar will detect all outbreaks.

11. Limitation of Liability

To the maximum extent permitted by law, VizTurf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to crop damage, turf loss, failed chemical applications, or missed spray windows. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

12. Termination

You may cancel your account at any time through the app settings or by emailing [email protected]. We may suspend or terminate your account for violation of these Terms, with notice when practicable. Upon termination, your right to use the service ceases, but you may request an export of your data within 30 days.

13. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
